Terms of Service & Compliance

1. NOT A MEDICAL DEVICE

ClearTone Pro is a Personal Sound Amplification Product (PSAP). It is NOT a medical device and is not intended to diagnose, treat, cure, or mitigate any disease. If you have hearing concerns, please consult a qualified professional.

2. Cancellation & Refund Policy

Due to essential health, hygiene standards for ear-worn equipment, and digital licensing protocols, all in-person sales of ClearTone Pro Earbuds are final. Once the earbuds have been unsealed, return and refund requests cannot be processed. This does not affect any right you have under Singapore law if a product is faulty. Purchases made through Google Play or the App Store are covered in Section 12.

3. Acoustic Shock & Sound Safety

Our real-time noise reduction is designed to make speech easier to hear; however, algorithms may occasionally process or mask certain environmental alerts (such as vehicle horns, sirens, or fire alarms). Additionally, Bluetooth signal fluctuations or system feedback loops could cause temporary audio volume spikes. By using the system, you acknowledge and assume these environmental sound safety and acoustic profile adjustments risks.

4. Limitation of Liability

To the maximum extent permitted by applicable commercial law in the Republic of Singapore, in no event shall DZ MATRIX or its affiliates be liable for any direct, indirect, incidental, or consequential damages resulting from audio misinterpretation, hardware mismatches, or system performance variations. Our total aggregate liability under this agreement is strictly limited to the actual amount paid by you for the hardware or software license in the preceding twelve (12) months.

5. Licence & Device Limit

Each ClearTone licence may be activated on up to four (4) devices. To enforce this limit, the App sends a device identifier to our server when the licence is checked (see our Privacy Policy). Unauthorized transfer, resale, or sublicensing of this software license is prohibited. Attempting to bypass licence checks will result in the licence being refused.

6. Usage Data

The Android version of the App includes Google Firebase Analytics, which collects standard usage data (such as app opens, session length, device model and approximate country) linked to a random app-instance identifier. We use it to understand how the App is used and to measure our advertising. The iPhone version contains no analytics SDK. Audio is never collected or transmitted. Details are in our Privacy Policy.

7. License Compliance & Termination

We reserve the right to suspend or terminate software license access if our security systems identify API abuse, reverse-engineering attempts, or active circumvention of licensing protocols. Termination is executed in compliance with service integrity standards without liability for digital disruption.

8. Jurisdiction & Arbitration

This service and agreement are exclusively drafted and governed under the laws of the Republic of Singapore. Any dispute will be resolved by binding individual arbitration in Singapore, or otherwise in the courts of Singapore, which have non-exclusive jurisdiction.

9. Warranty Disclaimer (“AS IS”)

ClearTone is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or free of harmful components. No oral or written information or advice given by us shall create a warranty.

10. Indemnification

You agree to defend, indemnify, and hold harmless DZ MATRIX, its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt arising from: (a) your use or misuse of the application; (b) your violation of any term of this agreement; (c) any claim that your use of ClearTone caused damage to a third party. This indemnification obligation shall survive the termination of this agreement and your use of the service.

11. Age Restriction

ClearTone is intended solely for users aged 18 years and older. By using this application, you represent and warrant that you are at least 18 years of age. If you are under 18, you may only use ClearTone under the direct supervision of a parent or legal guardian who agrees to be bound by these terms.

12. Subscriptions & Billing

Free trial: ClearTone includes a 7-day full-access trial inside the app. No payment method is required, and the trial does not automatically convert into a paid subscription.

Auto-renewal: ClearTone Pro monthly and yearly plans are auto-renewing subscriptions billed through your Google Play or Apple App Store account. Each plan renews automatically at the end of its period unless you cancel at least 24 hours before the renewal date.

Price charged: The amount charged is the price displayed in Google Play or the App Store for your country at the time of purchase, inclusive of any applicable tax. Prices differ between countries and may change; the store will notify you before any price increase takes effect.

How to cancel: On Android, open the Google Play Store, go to Menu > Subscriptions, select ClearTone and tap Cancel. On iPhone, open Settings, tap your name > Subscriptions, select ClearTone and tap Cancel Subscription. Cancelling stops all future charges. Your access continues until the end of the period you have already paid for.

Refunds: Refunds for subscriptions and for the one-time lifetime licence bought in the App are handled by Google Play or Apple under their own refund policies (for Apple, via reportaproblem.apple.com). Section 2 above concerns purchases made directly from us and does not limit any refund right you have under the store's policy or under Singapore law.
