Terms of Service & Compliance

1. NOT A PRECISION MEDICAL DEVICE

The ClearTone Pro is a Personal Sound Amplification Product (PSAP). It is NOT an FDA/MAS-approved hearing aid and is not intended to diagnose, treat, cure, or mitigate any disease or severe hearing loss. If you suspect hearing loss, consult a licensed audiologist immediately.

2. Cancellation & Refund Policy

Due to essential health, hygiene standards for ear-worn equipment, and digital licensing protocols, all sales of ClearTone Pro Earbuds and associated software licenses are final. Once the digital software box seal is broken or the Cloud API is activated via your hardware deep link, return and refund requests cannot be processed.

3. Acoustic Shock & Sound Safety

Our real-time AI neural noise processing is designed to optimize speech clarity; however, algorithms may occasionally process or mask certain environmental alerts (such as vehicle horns, sirens, or fire alarms). Additionally, Bluetooth signal fluctuations or system feedback loops could cause temporary audio volume spikes. By using the system, you acknowledge and assume these environmental sound safety and acoustic profile adjustments risks.

4. Limitation of Liability

To the maximum extent permitted by applicable commercial law in the Republic of Singapore, in no event shall DZ Digital or its affiliates be liable for any direct, indirect, incidental, or consequential damages resulting from audio misinterpretation, hardware mismatches, or system performance variations. Our total aggregate liability under this agreement is strictly limited to the actual amount paid by you for the hardware or software license in the preceding twelve (12) months.

5. Hardware & License Binding

Your cloud API and licensing keys are cryptographically paired to your headset's physical MAC address. Unauthorized transfer, resale, or sublicensing of this software license is prohibited. Attempting to spoof hardware signatures or bypass security handshakes will result in immediate license verification failure and a restriction of hardware software services.

6. Telemetry & Optimization

By utilizing this application, you consent to the collection of anonymous diagnostic telemetry, equalizer preset trends, and local DSP configuration metrics. This data is used solely to improve our neural processing models and enhance acoustic clarity. All personal identifiers are stripped prior to transmission, and you waive any intellectual property claims on optimized models generated from these aggregated insights.

7. License Compliance & Termination

We reserve the right to suspend or terminate software license access if our security systems identify API abuse, reverse-engineering attempts, or active circumvention of licensing protocols. Termination is executed in compliance with service integrity standards without liability for digital disruption.

8. Jurisdiction & Arbitration

This service and agreement are exclusively drafted and governed under the laws of the Republic of Singapore. Any legal proceedings or business disputes must occur strictly within binding individual arbitration in Singapore, waiving any rights to class action lawsuits or public jury trials.

9. Warranty Disclaimer (“AS IS”)

ClearTone is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or free of harmful components. No oral or written information or advice given by us shall create a warranty.

10. Indemnification

You agree to defend, indemnify, and hold harmless DZ Digital, its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt arising from: (a) your use or misuse of the application; (b) your violation of any term of this agreement; (c) any claim that your use of ClearTone caused damage to a third party. This indemnification obligation shall survive the termination of this agreement and your use of the service.

11. Age Restriction

ClearTone is intended solely for users aged 18 years and older. By using this application, you represent and warrant that you are at least 18 years of age. If you are under 18, you may only use ClearTone under the direct supervision of a parent or legal guardian who agrees to be bound by these terms.
